If you do not agree with any part of these Terms, please do not book or proceed with service.
You represent that you are over the age of 18. The Company does not permit those under 18 to book or receive services directly.

4. Services Provided
Jim's Heating & Cooling Services LLC provides residential and light commercial heating, ventilation, and air conditioning (HVAC) services including but not limited to:
- Furnace and heating system repair and installation
- Air conditioning repair and installation
- Full HVAC system replacements and new installations
- Preventive maintenance and seasonal tune-ups
- Indoor air quality improvements
- Urgent and emergency service calls
All services are performed in Southwest Michigan by Jim's Heating & Cooling Services LLC technicians or authorized subcontractors.
5. Estimates & Pricing
Free on-site and telephone estimates are available for most standard HVAC repairs and installations. An estimate is not a binding contract — it is our best assessment of the work required based on the information available at the time.
For diagnostic service calls, a trip/diagnostic fee may apply, which will be disclosed before the visit. This fee is typically credited toward the cost of repair if you proceed with service.
All pricing is presented to you before any work begins. We do not start work without your authorization. Prices quoted are valid for 30 days from the date of the estimate unless otherwise specified.
6. Payment Terms
Payment is due upon completion of service unless other arrangements have been made in writing in advance. We accept cash, check, and major credit cards.
- Late payments on invoiced accounts accrue interest at 1.5% per month (18% annually) on any outstanding balance after 30 days.
- Returned checks are subject to a $35 returned check fee.
- Deposit requirements may apply for large installations or equipment orders. Deposits are non-refundable if the Customer cancels after equipment has been ordered.
We reserve the right to refuse or cancel a service if fraud or an unauthorized or illegal transaction is suspected.
7. Scheduling, Cancellations & No-Shows
We do our best to show up on time and complete the work efficiently. We ask the same consideration in return.
- Cancellations: Please provide at least 24 hours' notice if you need to reschedule or cancel a non-emergency appointment.
- Late cancellations & no-shows: Cancellations with less than 24 hours' notice, or failure to be present at the time of service, may result in a service call fee.
- Emergency calls: We prioritize urgent issues as best we can. Emergency rates apply after 5:00 PM weekdays and Saturdays (1.5× standard rate) and all day Sundays (2× standard rate). Response times for non-emergency service are not guaranteed.
8. Warranty
Jim's Heating & Cooling Services LLC stands behind our work:
- Labor warranty: All repair and installation work is warranted for 1 year from the date of service. We will return and correct any defect in workmanship at no additional labor charge within the warranty period.
- Parts warranty: Replacement parts carry a minimum 5-year warranty on most parts. Many parts carry manufacturer warranties of 5–10 years. We will provide documentation of applicable manufacturer warranties upon request.
- New equipment: Full system installations include the manufacturer's warranty on equipment (typically 5–10 years depending on brand and registration) plus our 1-year labor warranty.
Warranties are void if the system is modified, misused, improperly maintained, or damaged by a third party after our service.
9. Customer Responsibilities
To allow us to perform quality work, you agree to:
- Provide safe, clear access to the HVAC system and related areas (attic, crawlspace, mechanical room, exterior units)
- Disclose known hazards (asbestos, mold, structural issues, pets) before the appointment
- Ensure a responsible adult (18+) is present during the service visit
- Inform us of any prior work performed on the system by another contractor
Jim's Heating & Cooling Services LLC is not responsible for damage or additional costs arising from conditions the Customer failed to disclose.
10. Limitation of Liability
Important: Jim's Heating & Cooling Services LLC's total liability for any claim arising from our services is limited to the amount paid by the Customer for the specific service that gave rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages, including lost income, property damage from pre-existing conditions, or costs resulting from system failures beyond our control.
Nothing in these Terms limits liability for personal injury caused by our negligence, which is governed by applicable Michigan law.
11. Pre-Existing Conditions & Older Systems
HVAC systems age and may have pre-existing conditions, wear, or code compliance issues unrelated to our service. Jim's Heating & Cooling Services LLC is not responsible for failures or additional costs related to pre-existing conditions discovered during or after service. We will notify you of any discovered issues and provide options before proceeding with additional work.
For older systems, we may recommend replacement over repair. The final decision is always yours.
12. Dispute Resolution
We prefer to resolve any concerns directly. If you have an issue with our service, please contact us first by phone at (269) 926-1512. We are committed to resolving issues promptly and fairly.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing any other legal remedy. Any unresolved disputes shall be submitted to binding arbitration under applicable Michigan law, to be held in Berrien County, Michigan.
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.
Any claim related to our services must be submitted within one (1) year of the date the service was performed. Claims submitted after this period will not be honored.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The current version is always available on our website. Continued use of our services after updates constitutes acceptance of the revised terms.
